Calverstown MX RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

I am aware that participating in Motocross and or off-road motor (off road motorcycle driving / quad or any other off road two or four wheeled vehicle driving) activities involves various risks, dangers and hazards.

I am aware of the risks, dangers and hazards associated with Motocross and off-road motor activities and I freely accept and fully assume all risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting there from.

and I agree to these Calverstown MX release of liability, waiver of claims and indemnity agreement terms and,

In consideration of Calverstown MX Trading Ltd and Pascal Walsh, and/or their agents, independent contractors, representatives, successors and assigns allowing me or the person(s) named on this form that are under my guardianship to participate in Motocross and /or off-road driving activities on the lands at 1 Blackhall, Calverstown. Kilcullen, Co Kildare (or any other lands now or any date hereafter in their legal ownership or under their control), and for all other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

1. To waive any and all claims that I or the person(s) named on this form that are under my guardianship have or may have in the future against Calverstown MX Trading Ltd and Pascal Walsh and to release Calverstown MX Trading Ltd and Pascal Walsh from any and all liability for any loss, damage, expense or injury including death that I / we may suffer or that my / our next of kin may suffer as a result of my / their participation in Motocross and /or off road driving activities on the afore mentioned lands, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under The Occupiers Liability Act 1995, on the part of Calverstown MX Trading Ltd and Pascal Walsh and their agents, independent contractors, representatives, successors and assigns and including the failure on the part of Calverstown MX Trading Ltd and Pascal Walsh and their agents, independent contractors, representatives, successors and assigns to safeguard or protect me from the risks, dangers and hazards of Motocross and off road driving activities .

2. To indemnify Calverstown MX Trading Ltd and Pascal Walsh and their agents, independent contractors, representatives, successors and assigns from any and all liability for any property damage or personal injury to any third party resulting as a consequence of my actions or the actions of the person(s) named on this form that are under my guardianship while participating in Motocross and or any off road driving activities or any other activities while present on the lands at 1 Blackhall, Calverstown. Kilcullen, Co Kildare (or any other lands now or any date hereafter in their legal ownership or under their control).

In entering into this agreement, I am not relying on any oral or written representations or statements made by Calverstown MX Trading Ltd and / or Pascal Walsh or their agents, independent contractors, representatives, successors and assigns other than what is set forth in this agreement.

I confirm that I have read and understood the agreement prior to signing it, and I also confirm that I am of sound body and mind and that I am aware that by accepting and entering into this agreement that I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatives may have against Calverstown MX Trading Ltd and Pascal Walsh and / or their agents, independent contractors, representatives, successors and assigns.

I also confirm that I am waiving the option to take legal advice prior to entering into this release of liability and waiver of claims and indemnity agreement.
